Sławomir D. was fined 300 PLN for attempting to burn the portrait of Tadeusz Rydzyk's father. The Toruń District Court found him guilty of careless handling of flammable materials on Wednesday. Other times, the same man burned the effigy in the image of Jaroslaw Kaczynski, but he did not suffer any punishment.
In May 2017, during the demonstration outside the headquarters of Radio Maryja, Sławomir D. attempted to burn the portrait with a stitched image of Father Tadeusz Rydzyk. In the court's opinion, the collage with its extraction gases and other circumstances accompanying this event has exhausted the signs of careless handling of flammable materials.
The accused Sławomir D., a theologian by training, did not appear in the verdict. During the investigation, he confessed to attempting to burn the image of the founder of Radio Maryja and Television Trwam. He argued however that the action was completely secure and that he did not believe, as his defender, the slightest risk of fire. The man also informed the services earlier of his event.
The colleague was ready to extinguish
This type of argument has not been shared by fire experts or the courts. In the justification of the verdict, Judge Krzysztof Dąbkiewicz pointed out that the circumstances of this event leave no doubt and that the facts have been reconstructed.
The defender of the accused Jakub Biłas told reporters that the decision on a possible appeal would be taken after hearing the written justification of the court's decision.
– During the entire process, we do not share the view that my client's actions constituted a threat. First of all, next to him was the second person equipped with tools to extinguish the manikin and he himself had kept all the precautions – said lawyer Biłas.
He added that his client had burned a Jaroslaw Kaczynski puppet during another protest in Warsaw. No penalty has been imposed for this act. The police did not even charge him.
The verdict delivered Wednesday in Toruń is not legally binding.
