The defendant is a Ukrainian investor, or Zaporoski Zakład Budowy Samochodów known as Awto-ZAZ. In 2005, a Ukrainian company for a symbolic PLN 100 bought from the Treasury 19.9% ​​of the shares, thanks to which it won 84.31% of the votes at the general meeting. At the time, it was hoped that through privatization, by selling to a Ukrainian investor, FSO would be able to protect itself from bankruptcy. The buyer is committed not only to continue the operation of the factory, but also to maintain employment and increase production under the program. five-year investment. He was also relying on the introduction of new car models with the code names T-250 and T-255. Investments were to reach 80 million euros

The choice of Awto-ZAZ was not a coincidence. About 90% went to the Ukrainian company. all the production of the FSO factories at that time.
