E-release in practice – what will the electronic L4 look like?

Polish doctors can issue an electronic medical certificate from 2016. From 1 December, electronic delivery has become mandatory. There is no shortage of doctors who sniff and say aloud that it will not burn. As usual, the patient is between the hammer and the anvil.

If you determine the digitization of the traditional L4 as a revolution, then it barely crawls. The first electronic version of the electronic edition was published in Poland in 2016. At that time, all employers with more than 5 people should set their profile on the ZUS electronic service platform. The others had their hands free in this respect.

The introduction of electronic redemption for public purposes has been postponed several times. It was to be applied in July of this year. Now, however, the processing is already finished and it seems that the deadline: December 1st can not be changed anymore. Of course, there is still no doubt. These, in turn, make the patient not very sure of what is expected after December 1st. We decided to check all possible scenarios.

Scenario # 1: a doctor on the network, that is, no problem.

This is the best situation for the patient. At the doctor, the computer equipment is adequate, there is no problem of access to the Internet. The doctor does not have to worry about the time that he devotes to writing an e-mail release. According to the regulations, he is a medical assistant for him.

The doctor signs the electronic release with the help of a ZUS certificate, a qualified electronic signature or a trusted signature. The document thus prepared is available on the profile of the employer at PUE ZUS, at the latest one day after the receipt of the electronic letter L4. The patient himself will also receive the appropriate information – if he also has a ZUS PUE profile. Those who decide to connect to the platform of the insurer can count on an additional installation:

We can activate the possibility of receiving an SMS to obtain a sick leave. From the doctor, the insured will immediately receive an SMS informing him that the doctor has issued him a certificate of incapacity for work and for how long. The employer can also activate the service of information via SMS on the sending of a medical certificate to his employee. Scenario 2: Off-network physician, but has an alternative.

It is possible that no matter where we go, the doctor will not have a computer or that the problems of access to the Internet will be longer and longer. They may also encounter problems when signing an electronic release, for example with a qualified electronic signature. Yes, otherwise the doctor will not be able to issue an electronic version. Then what?

In this case, the doctor must provide the insured with a medical certificate on the medical certificate form previously printed in the so-called document. an alternative mode of the ICT system. Currently, the doctor can print 150 medical certificates of this type, to be used in the absence of access to a computer, to the Internet or in the absence of electronic signature of the exemption. – explains Krzysztof Jakubiak, director of the Press and Promotion Office at the Ministry of Health.

Within three working days from the date of issue of the alternative medical certificate on paper, the doctor must electronically document the document in order to submit to the social insurance fund a medical certificate issued in the form of a medical certificate. Electronic document.

Scenario 3: doctor without network and without alternative.

This, in turn, is potentially the worst situation for the patient, but as much as possible. Some doctors do not fail to announce that I will put appropriate information at the door of their offices, that they can not emit online. In addition, the National Council of the National Union of Physicians stated that it was not the duty of physicians to write medical exemptions. In the opinion of OZZL, this service is not of a health nature, but only of a financial nature. However, the law on the profession of doctor and dentist, as well as the code of medical ethics, which easily stipulates the obligation to provide health services, must be recalled here.

It is possible that with a fever under the armpits we arrive at a doctor who, either because of technical problems or by taking such a different decision, did not send us an e-release, nor wrote it on an impression of substitution. In large cities, the problem can be solved by visiting new offices, hoping that the doctor will not have a major problem to adapt to the regulations in force, but in small towns and villages, the problem may be real. We must remember that in regulations requiring doctors to provide health services, there is no specific provision regarding the appearance of this benefit. It should contain only information about the doctor and the patient. In the worst case, the electronic version will become a simple piece of paper.

And if the doctor even refuses this activity?

Regarding the consequences of non-compliance, according to the law, the department has the option to temporarily revoke the authorization to issue medical certificates if the doctor violates the rules of conduct specified in the law. However, we will treat this solution as a last resort – informs the press service of the ZUS and adds that, especially during the first period, it will focus on information and education.

Remember: print yes, do not photocopy anymore.

We will review the situation when our employer does not have a ZUS PUE profile. Then the doctor will print an e-release (it will do so at our request). There will also be no problem in such situations during home visits and the doctor will not have to find a place for a mini-printer in his bag. He will simply use preprinted forms for this purpose.

There is no way to make photocopies. In accordance with the applicable provisions, electronic documents are made available with integrity, provided that they have been signed with an electronic signature, the validity of which can be verified by the recipient at the time of signing.

What if the electronic version contains an error?

It may also be that when writing an electronic version, the doctor simply makes a mistake. Electronic exemptions are not returned for correction. The doctor will inform the patient in writing of this error. If our employer does not have a ZUS PUE profile, we must remember the obligation to provide such information. Having this profile is much easier because in this case, information about the error and the cancellation of the electronic version are transmitted electronically.

The problem since the very beginning of the operation of this system is the failure of the ICT system. These failures often occur. This poses many problems for doctors and patients. First of all because we have to wait until the failure goes on to unsubscribe. The patients are annoyed by the fact that these prints will not come. They ask, they come back, they call, these fingerprints have surely been sent – says Anna Gawron of the Signum Clinic in Katowice.

ZUS trains and recalls the line of assistance.

The social insurance institution has trained doctors on how to display the electronic L4 for months. And thousands of doctors are already taking such courses. But the number of those who have not yet finished them is not optimistic.

We work all the time to have as many doctors as possible in this field. From January to the end of October, we organized over 2,000 physician training sessions and trained more than 8,000. – admits Beata Kopczyńska, ZUS spokesperson in the province of Silesia.
