Restrictions on Trade and Trade Related Activities on Sundays and Holidays
Art. 5. Sundays and Statutory Holidays in Business Establishments:
1) Commerce and Trade Related Activities,

12) in outlets in medical and other health care facilities for people whose health condition requires health services 24 hours a day or all day;
13) in the points of sale of railway stations within the meaning of the law of 16 December 2010 on public transport (OG 2017, articles 2136 and 2371), in ports and marinas within the meaning of the law of 20 December 1996 on seaports and marinas (Official Gazette 2017, post 1933) and in ports within the meaning of the law of 21 December 2000 on inland navigation (Official Journal of 2017) Article 2128) – in the field related to direct service of travelers;
14) in first-sale fish centers, in the case of the sale of fish from the ship's side, on fishing farms, commercial establishments receiving fish products and aquaculture and trade in these products;
15) in commercial establishments of airports within the meaning of the Law of 3 July 2002 – Aviation Law (Official Journal 2017, Articles 959 and 1089);
16) in the free zones;
17) in the means of transport, on ships, as well as on merchant ships, aircraft, oil rigs and other marine hydrotechnical vessels;
18) in the field of penitentiary units;
19) in commercial establishments in military units;

22) in the case of agricultural retail within the meaning of the Act of 25 August 2006 on food safety and nutrition (Journal of Laws of 2017, Articles 149 and 60);
23) at pharmaceutical wholesalers;
24) in the period from 1 June to 30 September of each calendar year – in retail outlets trading only with agricultural machinery and spare parts for such machinery;
25) in the case of the sale of flowers, bouquets, wreaths and candles in cemeteries;
26) in the funeral homes;
27) at points of sale where the business is managed by a contractor who is a natural person only in person, for his own account and for his own account;
28) in bakeries, confectioneries and ice cream parlors, where the predominant activity is in the bakery and confectionery trade;
29) in outlets where the predominant activity is the gastronomic activity;
30) on agri-food wholesale markets managed by commercial law firms whose main activity is the leasing and management of real estate for the wholesale trade of agri-food products;
31) in points of sale managed by entities purchasing products on the agri-food wholesale markets, referred to in Article 30, in the context of trade-related activities and entrusting the employee or the employee at these activities;
32) in outlets where you buy only cereals, sugar beets, fruits, vegetables or raw milk.
2. The predominant activity referred to in paragraphs 1, 2, 5, 6, 28, 29 and 30, the predominant type of activity indicated in the application for registration in the official national register entities of the national economy covered by the law of 29 June 1995 on official statistics (Journal of Laws from 2016, Article 1068 and from 2017 Article 60)

The use of occasional and unpaid help from family members in this case does not violate the provisions of the Act. These people however can not be employees or employees of such a contractor and do paid work on other days of the week.

Excluding the prohibition of sales outlets in which the business is run by a contractor who is a natural person solely for his own account? and for its own account, it includes only those cases in which the trader exclusively conducts his business or also applies to situations in which – as a general rule – the trade is carried out by employees or employees and only by the contractor of the forbidden days?
Exclusion of art. 6 para. 1 point 27 of the Act are covered by contractors who are a natural person who, on Sundays and holidays, do not use the work of employees or employees and only do business staff of those days. Exclusion of art. 6 para. 1 point 27 of the law on partners of a civil partnership will be possible, assuming that these people will trade in person, without the help of employees or employees. Penal Provisions

Art. 10. 1. Who, contrary to the prohibition of trade and the exercise of commercial activities on Sundays or holidays, entrusts the execution of works or related activities to the trade of an employee or an employee, is liable to a fine of 1,000 to 100,000 PLN.
2. The same penalty is imposed on any person who, contrary to the prohibition to exercise and engage in trade-related activities after 24 hours on December 24 or the Saturday immediately preceding the first day of Easter, entrusts the execution of a work or commercial activity.
Art. 11. Arbitration in cases concerning the acts referred to in art. 10, takes place under the provisions of the Act of August 24, 2001 – Code of Conduct for Offenses (Journal of Laws 2016, Article 1713, as amended).
