On Thursday, the court ordered Jerzy Owsiak to issue an apology for violating the personal rights of law and justice MP Krystyna Pawłowicz. He understands on a contest to decipher the abbreviation "RWKPWK" announced in May 2014 on the Internet. The verdict is not legally binding.

On Thursday, the Warsaw District Court announced the verdict in a civil trial, which Krystyna Pawłowicz, Deputy Justice and Justice Deputy, presented to the chairman of the WOŚP Foundation, Jerzy Owsiak. The main stakeholders have not reached a verdict.

The court forced Owsiak to publish on the website kreciola.tv a statement in which he apologized to Krystyna Pawłowicz for "unfounded wording concerning the application of the principles of the PRL, as well as the organization of a contest consisting of deciphering the abbreviation "RWKPWK", which violated his personal rights in the form dignity in the film of May 12 ". The declaration must be suspended on the site for a period of 2 weeks.

On the same page, the head of the Grand Orchestra of the Christmas Charity must also issue a statement in which he apologizes to Krystyna Pawłowicz "for an unjustified suggestion regarding the state of normalcy infringing on his personal rights in form of honor and dignity in the film of June 2, 2014 ". The statement must be published on the website kreciola.tv for 48 hours.

Both statements should be published within 7 days of the decision being made.

The court rejected the claim of Krystyna Pawłowicz in the part relating to financial compensation. He determined that Krystyna Pawłowicz would incur costs in non-pecuniary claims in 35% of cases and defendant Jerzy Owsiak in 65% of cases. As regards the property claim, Pawłowicz will bear all the costs of the proceedings.

Judge Krzysztof iderswiderski noted that only part of the statements in the films violated the applicant's personal rights. This should include for a statement regarding the dispatch of Krystyna Pawłowicz to space and the organization of a contest to decipher the abbreviation "RWKPWK". "In the court's opinion, organize such a contest and use the wording regarding the sending of a plaintiff in the space violate the dignity of the plaintiff, suggest that the plaintiff is a person to absurd views and that it should be isolated and sent into the space, "explained Judge Świderski.

He added that, in the opinion of the court, which had also violated the applicant's personal rights, the comparisons concerning the principles followed by Pawłowicz should be recognized and compared with the principles applied at the time of the LRP. "In the court's opinion, these formulations are shocking, constitute an assessment, but according to the court's opinion, an unauthorized evaluation" – said widerski. He added that the court had in mind that the publication of these statements was linked to Pawłowicz's statement about Władysław Bartoszewski, which, he said, was offensive and negative, "but that is reflected in the warning of the Ethics Committee ".

"Comparing the plaintiff's statements to the press or to the security organs of the PRL is a far-reaching and unauthorized comparison (…), all the more so as the plaintiff declares his patriotic attitude in any way in the evaluation of the court with this system "- said iderswiderski.

The other statements of the court's opinion did not violate the applicant's personal rights.

Plenipotentiary Jerzy Owsiak, Jarosław Kowalewski, said at the end of the verdict that he should be positively assessed "at least in part". "Let me remind you that Mrs Pawłowicz has asked Mr Jerzy Owsiak to obtain compensation in the amount of almost PLN 50 000. He will not have a zloty, c & # 39; is certainly the success of Jerzy Owsiak, but we will appeal in principle against this verdict, "said Kowalewski.

Krystyna Pawłowicz's prosecutor, Artur Wdowczyk, said Krystyna Pawłowicz would take the decision on the appeal. "I can only say that we have won in principle, and if we will appeal, the professor will decide, I think we will ask for a justification," he said.

Pawłowicz, referring to the verdict, wrote on Twitter: "I won the second civil trial with J. Owsiak, I have to excuse, now criminal trials".

The process was linked to the films published in May and June 2014 on the website kreciola.tv. In the first, a contest was announced to decipher the abbreviation "RWKPWK".

The defendant explained that the solution announced a few weeks later concerned the "Krystyna Pawłowicz sentencing movement in space". In turn, the trial's authors indicated that there was already a profile on one of the portals with the same abbreviation, where one of the words was unproductive – "Ruch Wypie … Krystyny Pawłowicz in Kosmos ".

"I think Owsiak inspired this site (…) if, as part of the contest, he had to decipher the abbreviation of this vulgar page, which we are talking about," Pavlovich said. The trial's authors also pointed out that the competition to decipher the abbreviation "RWKPWK" had caused a wave of hate entries on the Internet.

The Law and Justice Representative asked Mr. Owsiak to apologize for Mr. Owsiak's profiles on social media and on the kreciola.tv website, as well as 50,000 compensation.

Earlier in late October, Pawłowicz had illegally won another civil lawsuit with Owsiak. On the basis of this verdict, Owsiak must apologize to a deputy and pay 10,000 euros. compensation.

In this case, these were words spoken by Owsiak to Pawłowicz at Przystanek Woodstock. "Let yourself be tempted by sex, feel the butterflies in your stomach, feel your back relaxed, feel the flower in your hair, and so your head can also get in order", was the statement that was the subject of this case.
