The prosecutor's office did its best not to accept a deposit of 108 million zlotys. The construction was intended to not leave free the creator of Altus TFI. But the court stayed by his side and Tuesday night he was released.

Whoever thought that when the court decided to release the prisoner, he might be ready to leave the cell. Such a conclusion stems from the events of Tuesday concerning Piotr Osiecki and Jakub Ryba. when Late in the afternoon, Judge Marcin Kosowski approved the defense's request to turn the preventive measure into preventive detention into a useful one.it seemed that the question of the hours of former directors of Altus TFI was free. The prosecutor's office, however, decided to fight until the end, and absolutely. But one by one.

Prosecutor behind the barricade:

Katarzyna Szwarc, defender of Piotr Osiecki, encountered unexpected problems in the form of a difficult entry into the building when she came to file a financial bond. But eventually it worked.

Just before the hours. In the morning of 8 am, the defenders of Piotr Osiecki went to the Warsaw Regional Prosecutor's Office to deposit bills of exchange with notarial offices of 10 businessmen and three companies, for a fee of 108 million zlotys. The court ruled that such bail would be a sufficient preventive measure, although after the retrial on Monday, defense lawyers presented a guarantee of 180 million zlotys. The value has increased as more and more people have said they want to support Piotr Osiecki. At the same time, Jakub Ryba 's lawyer appeared to collect the acceptance protocol (1 million zlotys were paid by bank transfer). Both groups thought that it was only a formality. However, at first they were not allowed to enter the building and, after several minutes, the prosecutor Wojciech Smoleń told them that the prosecutor's office would be useful only when the court would consider the petition to set aside the feasibility of the court decision Monday. The prosecution asked the court to appeal the verdict of the district court to the court of appeal.

– The prosecutor's office refuses to accept bail, arguing that she has filed a complaint against the court's decision, but that the complaint does not stop the execution of the court's decision. The prosecutor's office is being tried, commented Katarzyna Szwarc, defender of Piotr Osiecki.

The next few hours have passed for both parties to wait for the court's decision. The meeting began before 14, Judge Marcin Kosowski needed several tens of minutes to deny the prosecutor's request to suspend the feasibility of his Monday ruling. This meant that the prosecutor's office had to accept a bond. However, the defenders again encountered an unexpected barrier: after a dozen minutes of detention in the vestibule, they were allowed to enter the building. The procedure for accepting security and establishing protocols to get out of detention began. After 16 hours, the deposit for Jakub Rybka is accepted and after 17:30, the formalities concerning Piotr Osiecki are completed. According to the findings of "PB" after 19 years, Jakub Ryba and Piotr Osiecki were already on the run.

The lawyers criticize the functioning of the prosecutor's office and describe it as constipation.

– Provisions relating to preventive measures are enforceable as soon as they are published, unless the court decides otherwise. In this case, due to the change of the preventive measure consisting of a temporary arrest for guarantee of property, the suspect must leave the arrest immediately after submitting the bond, any obstruction in this regard is unacceptable – says Marcin Melzacki , lawyer at LSW.

Piotr Osiecki and Jakub Rybak were arrested on August 29, after the prosecutor's office accused them of "hurting big business with GetBack". According to the investigators, the collusion of Konrad K., former president of GetBack arrested and Piotr Osiecki, former president of Altus TFI, resulted from the sale of EGB Investments to GetBack, following which the collection company bought the company controlled by TFI at a higher price. According to investigators, the valuation of the entity would have been overvalued by at least 160 million PLN.
