The Supreme Administrative Court ruled that the missionary activity funded by the subscription was not an activity economic. This means that Polskie Radio and TVP deduct less VAT – reports Dziennik Gazeta Prawna

This is a provision in force since 1 January 2016, which changed the rules for the refund of VAT on goods and services used simultaneously for exempted activities the one that is not released. The more non-business activities are important, the less tax to deduct.

In early 2017, unfavorable judgments on the public media were brought before the Provincial Administrative Court. The judgment of the Supreme Administrative Court is also not for the Polish Radio and TVP authorities.

From the beginning, the taxman argued that the missionary activity of Polskie Radio and TVP meets the definition of "non-economic activity" because the public media persist not only by commercials and other commercial sources, but also by a kind of public tribute. .

The NSA did not agree that revenues from subscription fees are intended solely to cover general operating expenses. The court will emphasize that since the subscription fees are not mandatory, it is not a reward. Thus, the activities carried out within its framework are exclusive of VAT.

According to "DGP", with this interpretation, utilities deduct less VAT. Polish radio loses about 15 million zlotys a year and TVP loses even 100 million zlotys.
