The Maryland police are investigating why a newborn baby girl was left alone in the woods without even a diaper.

The baby was rescued in Silver Spring, Maryland, on Friday, when a passerby heard him crying in a nearby street, police said. The baby's crying may have saved his life.

"He went to investigate the noise and found a naked baby about ten meters from the sidewalk in the woods," the Montgomery County Police Department said Friday in a statement. "The girl has been transported to a local hospital where she is in a stable state."

Medical staff at the hospital said the baby seemed to be only a few hours old. The investigators found the child's mother Sunday, but they have not yet determined why the baby was left naked and unattended.

Police said the mother was receiving medical care at a hospital, but did not provide details about her condition. The baby was listed in a stable condition Sunday night.

The department said that its special investigations division was dealing with the ongoing investigation and that it "will not be released any additional information at the moment".

The law allows a "parent in distress" who can not or will not take care of his baby without asking questions.

By law, a parent, or other adult with the approval of the mother, has up to 10 days from birth to anonymously leave a baby with a responsible adult in a place designated by Safe Haven , according to the Department of Human Resources.

"In Maryland, no one should ever abandon a newborn," said the Department of Human Resources in a statement. "A person who invokes Safe Haven is immune from any civil liability or criminal prosecution as long as the child is unharmed."
