A hotel in Miranda do Corvo today accused the Supreme Court of Justice (STJ) of having acted "in the service of the lóbi" of construction in the process by which it had been sentenced to pay 628,000 euros. at the construction company.
"In our case, the Supreme was, in our opinion, frankly fake and clearly in the service of the lobby," said Jaime Ramos, president of the ADFP Foundation, owner of the hotel Parque Serra da Lousã (HPSL).
In recent days, the County Court of Coimbra has ordered the seizure of bank and hotel assets of the company for an amount greater than 82,000 euros, reported Tuesday the Lusa news agency, citing sources relating to the trial.
In June, the HPSL was ordered to pay Jobipiso € 628 thousand, plus interest on the amounts due until their liquidation, relating to unpaid and overdue invoices, additional work, final balance of the contractual price determined in favor of of the applicant, net loss of profit due to the impossibility of carrying out the work and the interest on late payment.
In 2012, the hotel company operating in Quinta da Paiva, Coimbra District, entered into an agreement with the Coimbra Construction Company, which was subsequently the subject of a joint legal action. the Promoter for alleged breach of contract. business.
The parties agreed that, for the "settlement of all disputes arising from this contract", the arbitration center of the Association of Civil Construction and Public Works Builders (AICCOPN) had exclusive jurisdiction over the dispute. , which HPSL then claimed to be disengaged.
"Remove the right of a person to be tried by a state court" and continue to "manipulate the orders of the association and this arbitral tribunal" constitutes, of the opinion of Jaime Ramos, "a deep injustice and arbitrariness".
The court in Coimbra pledged balances at hotels and bank accounts. However, the company disputes the execution and requests the lifting of the seizure within a legal period of 20 days.
Jaime Ramos told reporters today that even if the company did not have the financial conditions to repay the debt of the old construction company, the building and the land would go back to the municipality – not to Jobipiso or to the company. 'other creditors – as provided in the act of the municipality celebrated with the ADFP during the last decade, when the room of Miranda do Corvo was chaired by the current member of the Social Democrat Congress , Fátima Ramos, sister of the president of the foundation.
The HPSL employs 30 people in the tourism sector "besides more than 20 people in related activities," he said.
"We are available to conclude an agreement with the company, in a way that we think is fair," said Lusa guest speaker Jaime Ramos.
In this dispute, the hotel "was the target of a Kafkaesque situation, in front of a court of arbitration dominated by the lobby of construction companies," he criticized.
"We hope that the Constitutional Court and the Porto Court of Appeal will require the arbitral tribunal to review the judgment," he added.
The decision of the STJ, contrary to a decision of the court of appeal of Coimbra and "to prevent this litigation being judged by a court of the Portuguese State, reveals the power of this lóbi ".
"If we lose, we know that we are suffering an injustice, like many Portuguese robbed and deceived by criminals, some of whom are white-collar," added the president of the ADFP.
