NEW YORK (AP) – The Manhattan prosecutor has asked a judge to reject President Donald Trump's efforts to prevent prosecutors from getting his tax return, saying the president wanted "radical immunity".
District Attorney Cyrus R. Vance Jr. filed federal court documents after Trump's lawyers sued Vance to force the president's accounting firm to release eight years of state and federal declarations in the context of a criminal investigation.
Vance urged a judge to reject Trump's application for an order to block the appearance of Vance documents in an investigation into payments to two women who claimed to have had dealings with Trump. He also asked US District Judge Victor Marrero to file the complaint.
Vance said that Trump asserted "the remarkable proposition" that a sitting president not only enjoys general immunity from criminal prosecution, but he is not obliged to submit to a systematic request either. the grand jury to obtain information about what he, his company or his employees have done.
"The law does not provide for such immunity," the court documents said.
"Here the question is not whether a prosecutor can indict a sitting president," the newspapers said. "Instead, the question is whether a third party, having duly served a summons before the grand jury, soliciting the books and records of several natural and legal persons, including those of the president, must comply to this assignment. "
Trump's lawyers have called Vance's summonses, a Democrat, an "attempt of harassment in bad faith."
Trump's lawyers say the files should not be published until Trump has left office.
