Kelly was charged with 10 counts of aggravated sexual abuse about a month after Foxx called her accusers following a documentary series that she described as "deeply disturbing." ". Avenatti, known to represent adult movie star Stormy Daniels, claimed to represent several people related to Kelly's alleged misconduct.

In February, Avenatti claimed to have handed a VHS tape to Cook County attorneys showing Kelly sexually assaulting a 14-year-old girl – a tape that later became the focus of one of the new indictments against the singer.

"Avenatti acted as de facto prosecutor, apparently with the full cooperation of the state prosecutor," said the petition.

Last week, Avenatti had been indicted by the federal government in New York, accusing him of attempting to extort Nike and California by fraud-related charges.

Meanwhile, Foxx has been criticized for treating the Smollett case by his office. The actor was accused of organizing a racist and homophobic attack against himself, but prosecutors dropped all charges against him on Tuesday at a shocking audition at the last minute before the court.

Foxx withdrew from the investigation early after contacting a member of Smollett's family, a decision she regretted last week.
