According to the French legal system, the adjective “witness benefiting from assistance” is considered as an intermediary between the attributes of the witness and the accused.
The lawyer Thierry Marambre confirmed the information published by the magazine “Le Point” on this subject, affirming that “this decision reaffirms that there is no basis for the facts” of which Luc Besson was accused.
He said that “this comes after a first decision in February 2019 to save the case and the requests of a deputy prosecutor at the Paris prosecutor’s office after the opening of a judicial investigation”.
Agence France-Presse was unable to obtain any confirmation from a judicial source on Monday evening of the results of Besson’s first interrogation in the case.
Neither Van Roy nor his lawyer, Frances Zepigny, have yet commented on the decision.
Van Roy filed a complaint against Besson (60) on May 18, 2018, after a meeting with him at the luxurious “Bristol” hotel in Paris.
Two months later, she claimed he raped and sexually assaulted her four times in two years. She recounted in her testimony that during those two years she had had an intimate relationship with the director that she felt obligated, given their professional relationship.
The Paris prosecutor’s office filed these complaints on February 25.
However, the actress quickly filed a new complaint with a civil law action, a process that allows a judge to be appointed almost automatically to restart investigations. This complaint led to the opening of an investigation on October 2, 2019 into the rape charges. The Paris prosecutor’s office informed the judge of his opposition to the relaunch of the investigations.
After Van Roy’s complaint, eight women accused the director of “Le Grand Blue” of harassing or sexually assaulting them, according to testimonies they gave to MediaBar.
The French director admitted in October 2019 that he had an affair with Van Roy, but dismissed his rape allegations, saying they were “imagined”.
“This case is a lie from A to Z,” he said. “I did not rape this woman, and I did not abuse any woman in my life.” “I never raised my hand on a woman and never threatened a woman … I did not drug this woman like they said. That’s a lie.”
Luc Besson continued: “(But I) betrayed my wife and my children. I did not betray them once, but it happened several times in our 20 years of marriage.”
