An accounting audit conducted by a company working in the field of school publications revealed that its business manager exploited her duties to harm her and deprived her of financial profits, obtaining for himself sums of money in excess of 4 million of dirhams.

In detail, the company (complainant) filed a complaint with the Abu Dhabi Court of First Instance, asking to oblige its commercial director to pay it an amount of 4,118,536 dirhams, and obliging it to pay compensation. of 7 million dirhams in compensation for the damage suffered. that she suffered as a result of the use of her labor, while he works reselling them to the complainant’s clients at prices higher than those he bought from the complainant, for which she is entitled to compensation .

Explaining her request, she said that while the technical staff gathered information about the accounting system of the company (complainant), it became clear to her the action of the respondent.

It noted that the defendant, in his capacity as commercial director, is responsible for determining the prices of products sold to customers, including the company he owns, which proves that the defendant benefited from the value of the discounts granted to her company and obtained profits, and that the plaintiff suffered prejudice in her work by the loss of income if she had sold the same products for another company.

The court decided to delegate a committee of experts, which revealed that a company was owned by the defendant, and that the plaintiff’s damages amounted to 4,118,536 dirhams, based on the highest price at which the study publications were sold to other customers.

The defendant replied that his company was acting as an intermediary for the benefit of the plaintiff and that the transaction was to its knowledge and that it did not carry out any activity which competed with that of the plaintiff and did not cause it any prejudice.

As a result, the court ruled, requiring the defendant to pay the plaintiff company an amount of 4,618,546 dirhams.
