Qualcomm may be subject to a ban on some models of iPhone in the United States

The US International Trade Court ruled in the ongoing case between Apple and Qualcomm. In one case, it turned out that Apple was not guilty, but in the second case, the judge ruled in favor of Qualcomm and accused Apple of violating a patent belonging to Qualcomm.

Judge MaryJoan McNamara said that she would recommend banning the sale of all models of iPhone infringing the Qualcomm patent in the United States. Qualcomm claims that Apple A10 devices at Apple A12 Bionic violate its intellectual property rights, which are used in modern iPhone phones, ranging from the iPhone 7 to the iPhone XS Max. The original complaint concerned only the iPhone 7 and iPhone 7 Plus. The decision is not final and a group of governors will issue a resolution by 26 July at the latest. This resolution will then be forwarded to President Donald Trump for approval.

Note that if this prohibition is approved, it will only affect iPhone phones using the Intel modem. In other words, the iPhone phones of Verizon and Sprint customers in the United States will not be affected by this ban, as these phones use the Qualcomm modem.

By the way, the patent mentioned is patent 8063674, which describes the mechanism of energy management. There is no question of audio management innocence, which has redesigned old Apple phones to continue to sell in Germany. It should be noted that another judge had already concluded that Apple had violated the invention of energy management, but had decided not to ban.

All of this is part of the great war between the two societies. Qualcomm patents are essential for all modern wireless devices. The company charges a fee on devices that use its patents, even if they do not use their chips. However, the company is obliged to license these patents under fair and reasonable conditions, but Apple says that this does not happen. Apple believes that Qualcomm is charging large sums of money and has stopped paying fees until the problem is resolved.

Two years ago, the Federal Trade Commission accused Qualcomm of forcing companies to use their products exclusively and charging them surcharges. As you can imagine, Apple has accepted this accusation, but Qualcomm does not accept it.
