Dakar, July 7 (APS) – The document brandished as the judgment of the ECOWAS Court of Justice is "an excerpt from the plumitif" unsigned by judges, said, on Saturday, Me Moussa Félix Sow , attorney of the Senegalese State in the case of Khalifa Sall, former president of the Bar Association

'' The document which is brandished as the judgment of the Court of Justice of ECOWAS, is actually an excerpt from the plumitif that is not signed by any of the judges who are supposed to have rendered [l’arrêt]"he said, on behalf of the Khalifa State Lawyers Collective. Sall et Cie during a press conference.

The mayor of the city of Dakar and his co-defendants were sentenced to 5 years imprisonment and a fine of 5 million for forgery and use of forgery and fraud involving public funds

'' It should be noted that so far this decision is not always available, although commented and interpreted for a week '', hammered the former president of the Bar Association. According to him, the document gives "no indication of the arguments and the reasons given by the judges, and does not allow, without extrapolation of chance, any critical analysis or hasty decision".

"Pending receipt of notification of the decision rendered, we can take cognizance of the device certified by the clerk of the court circulating under the mantle in the city of Dakar", he said.

[19659005] Mr. Sow assured that the State of Senegal remains respectful of all the decisions of the national courts, regional as international, whatever the person concerned.

He recalled that the case Khalifa Sall and Co. had nothing to do with a political trial, but is rather a record of "fraudulently used" public money, and to this end he asked both to avoid interpretations likely to distort the decision of ECOWAS

'' For the moment, the decision is not yet available. We explained in a statement, that Senegal is a state of law and also respectful of the decisions of the Regional Court, "for its part pointed out the judicial officer of the State, Mr. Mamadou Bitèye. As a precautionary measure, he recommended, it would be wiser to have decisions before addressing aspects that concern them.

'' Whether it is at the national or international level, it has happened several times, trying to make the decisions say what they did not say '', did he regretted.

The ECOWAS Court of Justice, a community court ruling on human rights issues, issued a ruling on 29 June in the case of Senegal's Khalifa Ababacar Sall and Cie.

This decision follows the seizin of this regional court by defendants Khalifa Sall and Co. for cases of human rights violations of which they would have been victims in the context of the legal proceedings against them in relation to the management of the advance fund of the city of Dakar.

The exit of the lawyers of the State arises the day after that of the lawyers of Khalifa Sall whose trial in appeal will be held from this Monday. The councils of the mayor of Dakar believe that the decision of the community court answered their eight requests, judging in particular that their client was a victim of "arbitrary detention", which induces his "immediate release and without delay '
