I have a hard time pronouncing his name, so he smells of sulfur. Those who read the edition of the daily 'Liberation' of June 16, 2019 know who this is about. In a text published in full by this newspaper, he attacks me. I certainly would not have answered his diatribe, had it not been for the name of this honorable lady that he presents as my source. This can not be the case, for reasons I do not dwell on. Above all, she is very conscious of her responsibilities, of her status, so as not to allow herself to be the source of anyone. There is also that I write for forty years. I only knew the respectable lady in August 2014. The sources of my contributions and other outings that made the former "financial adviser" of the old president-politician out of his pockets are essentially public. These are, among others, the reports of the Court of Accounts, the public reports on the State of Governance and the Accountability of the State General Inspectorate (IGE). These reports are the result of a reform of the institution which requires the Auditor General of Senegal to submit, each year, to the President of the Republic, a report of activities on the state of public governance (RGP). This RGP presents to the President of the Republic, the citizens and the technical and financial partners, a summary of the main results of the missions of the State General Inspectorate. The public report of the IGE of July 2013 that overwhelms the former Minister of Energy of the old president-politician is one of them. The individual clings behind an alleged "pre-report that retains its provisional character despite its relevance". He refers me to his observations on the preliminary pre-report and even dares to say that, "it is after that that the case was closed without further action". That he can be dishonest, this individual! Case closed without continuation! Ask the public report of the IGE of July 2013!
The report reviewed a number of illustrative acts of poor financial governance, including, in particular, those at the African Refining Company (ARS), with the "great feats of arms" of the former Minister of Energy and former "financial adviser" of the old president-politician. As a reminder, the SAR imports crude oil in order to refine it to ensure the regular supply of the Senegalese market in various finished products. The IGE Report states that the Company imported in 2008 a cargo of 122,222 tonnes of crude oil from the supplier Arcadia Petroleum Limited (APL), which shipped it from Nigeria on board the M / T OLINDA ". It will be remembered that this cargo contained a huge quantity of water mixed with petroleum and was, moreover, imported by the SAR "under conditions marked by many irregularities, failures and other malfunctions". These irregularities and other shortcomings have been described in detail in the 2013 Report (pp. 116-120).
In particular, the import of the '' Olinda '' shipment had not been the subject of any call for tenders, nor of the application of the provisions of the Public Procurement Code then in force, nor of the application the internal SAR bidding procedure. In total, fourteen (14) cargoes (9 in 2008 and 5 in 2009) will be imported under exactly the same conditions and from the same supplier, for an aggregate value of four hundred and ninety-five billion three hundred and sixty-five million dollars ( 495,365,000,000) of CFA francs. It's enormous ! This case is far, far from being closed.
Most surprisingly, the same APL supplier was chosen "at the mere instruction of the former Minister of Energy addressed to the former President of the Board of Directors of the SAR by confidential letter n ° 00159 / ME / CAB of May 05, 2008 ". More importantly, in his famous letter, our minister demanded that "the RAD does not tender for its supply of crude oil, invoking a government-to-government contract". G '' supposed to link Nigeria to Senegal, in the field of supply of crude oil ''. However, this "G to G" contract did not exist anywhere in the SAR and was unknown to all the managers of the Company as successor to Samuel Sarr. He existed only in his imagination and translated his morbid will to easily make billions.
The oil was therefore imported in the absence of any order document, on the basis of a contract concluded between the two parties (the Minister and APL), on June 5, 2008, which fixes a price with a differential of 6, US $ 15 per barrel. An "excessive differential, compared to the differentials negotiated with" traders "as a result of tenders for similar cargoes", in the opinion of the leaders of the SAR. To further confound our minister, the report states: "The TOTAL Corporation, through one of its former SAR administrators, had even offered to deliver to the refinery a cargo of crude oil for a fee. differential of about US $ 3 per barrel, which was not accepted. The memorandum he has drawn up on this subject confirms that the differential was at that period at US $ 3.30 per barrel ".
The brigandage organized by the former Minister of Energy will therefore have caused the SAR, for each barrel of crude, to lose the difference between the $ 6.15 paid to APL and the US $ 3.3 of the offer of sale. made by TOTAL. This loss "calculated by applying the same parameters as to determine the invoice value of the whole cargo", equals two billion one hundred and seventy-four million eight hundred and seventy-five thousand one hundred and eighty-three (2,174,875,183 ) CFA francs.
The controllers did not stop there: they also highlighted many other significant losses for SAR (pp. 119-120). In particular, by deliberately buying water at the price of crude oil, the SAR will have lost an amount of one billion one hundred and sixty-four million three hundred and six thousand nine hundred and forty-eight (1,164,306,948) CFA francs, to which more than five billion were added, "because of the delays in the manufacture of these refined products and the less favorable evolution of their selling prices".
By aggregating the various losses, losses and other incremental costs, the IGE Report estimates the injury overall suffered by the SAR, for the sole import OLINDA, "at least nine billion seven hundred and eighty-seven million seven hundred sixty-nine thousand and seventy-seven (9,796,769,077) CFA francs ". It also notes "the strong presumption of collusion of interests with the APL supplier to the prejudice of the SAR, with the complicity of the former Minister of Energy and the former Director General of the (Company)". And for these accumulated packages, "the IGE (proposed) the opening of a judicial information against the former Minister of Energy and the former Director General of the SAR".
This is to summarize the acts of brigandage of the former Minister of Energy at the level of the SAR. And today he has the knack of going around the editorial offices to talk about "classified business". The same report pushes it even more by bringing to the surface other '' illustrative acts of poor governance '', which took place in the State Automobile Park.
