The users were punished, and the companies did not try to bind them by themselves. After the market, the parent ministry initiated the collective protection of consumers. Unfair contract terms have been identified as they force the consumer to pay fees that significantly exceed the trader's damages.
"Traders, or operators, are required to remove these unfair contractual obligations from the subscription contracts, to change the contract templates, which virtually means that all consumers who will be in the future they conclude that these contracts are exempt from the obligation to pay manifestly unfair damages and that what is good when the general conditions are changed, is that such changes apply to consumers who are still in a contractual relationship, ie what are the contracts, "says Stefan Cvetkovic of the Ministry of Commerce, Tourism and Telecommunications
The question is, however, what do consumers do in the framework of the new law
"Consumers who are possibly condemned on this contractual basis they can refer to unfair contractual terms and consider that knowing the the damage suffered and therefore be compensated. At this time, only individual consumer complaints can be filed, and we advocate for the return of a collective lawsuit where more efficiently a large number of consumers, without individually entering the legal proceedings, could be compensated " says Nikica Jovanovic of the National Consumer Organization of Serbia.
Consumers are economically weaker, but merchants invest in the service, rely on revenue, and suffer damages after termination of the contract.
In the future law on electronic communications, the best solution European practices give consumers the choice – to repay the amount of the discounts they have obtained through a fixed-term contract, or to pay the the amount of all remaining wars until the expiry of the contract, from the date of termination of the contract.
