PUTRAJAYA : For the first time, a nine-member court of the Federal Court will sit to hear appeals in five cases involving children born in Malaysia but unable to obtain citizenship on August 30 of this year.
Lawyer Latheefa Koya, who represents two of the children, told reporters that the case was set for the management of affairs today before the Deputy Registrar of the Federal Court Syahrin Jeli Bohari
She said Syahrin had informed the parties in appeals that in light of the new directive of newly appointed Chief Justice Tan Sri Richard Malanjum, a nine-person court would be formed to hear appeals.
Latheefa said that the deputy registrar had canceled the earlier court dates set for July 23 and July this year the hearing was postponed until August 30.
On September 11 of last year, the Federal Court granted leave to appeal on several legal issues, including whether the reference to blood or lineage The Federal Constitution in Determination of the citizenship of the child.
The first two cases involved a 20-year-old whose biological parents were unknown and had been adopted by Malaysian parents, and an eight-year-old boy born Malay father and Thai mother who was not legally married to his birth
The Court of Appeal dismissed the appeal of last year with respect to their citizenship offers after deciding that they should also have proven that They are not citizens of other countries.
Two other cases involved two boys, aged 17 and 16, both of whom had unknown biological parents and were adopted separately by two Malaysian couples.
Meanwhile, the fifth case involving a 13-year-old girl won her citizenship application in the Court of Appeal, but her case was brought before the Federal Court when the government appealed.
Last week, Malanjum proposed forming a nine-member bench to hear constitutional cases and a seven-member panel
