Another judge retires, closing of the trial becomes more complicated

Another Bratislava Bratislava District Court Judge (OS BA I), Stanislav Dutko, is retiring, which complicates the speedy resolution in his case of more than 100 pending cases, including a number of pending cases. Misconduct on the part of the media.

Tibor V. Sudca has he also dealt with the well-known case of platinum networks, where the former head of state, Ján K.

He will assign them to the new judge

In any case, following the departure of the judge and the large-scale transfer of writings by new judges and their study, the accused may not agree with the new composition of the Senate. This would mean that much evidence in ordinary business and affairs should be made again. Therefore, the legitimate decisions of the KS appeal in the BA case could be published for several years.

In the above-mentioned case, Miroslav M., who is serving a ten-year sentence of imprisonment in Slovakia for the expulsion of business leaders based on a more recent judicial decision rendered in Czech, Zlín, OS BA I is currently awaiting the decision of the Trencin Regional Court in another criminal case. Miroslav M. is excluded from the Trencin court for an independent hearing. He and his accomplice figure in dozens of criminal cases.

In the case of Jozef Drago et al. the case was forwarded to the specialized criminal court of Pezinok (STS), at the request of OS BA I. The case includes 14 people accused of fraud between 2004 and 2007. One of the defendants is died in the meantime.

The real estate in millions of values ​​had to be carried away by actors – actors for several thousand crowns. The organizers had to provide them with false identity documents. In this case, the years have not been discussed for various reasons. Judge Dutko "inherited" the case after Judge Pavlov Dekánek, who had not done so for a long time and who had long ago given up the post of judge.

In the following case, the suspected drug group Tibor V. OS BA I has already decided. The KS in Bratislava has returned the case to the court of first instance and the case is ready for a new hearing. He then dealt with the answers of Judge Dutka, President Adamčiak. In the Tibor V. case and the co-defendants previously, the aforementioned former Justice Dekánek ruled.

Finally, in the case of the defendant Ján K. in the case of platinum, experts are being heard. Ján K. was excluded from the case for a separate proceeding, unlike the other two co-defendants. OS BA I, where he was chairman of the Dutko Senate in January of this year, sentenced expert Ondrej B. to a ten-year prison term.

At the same time, he imposed on her a one – year custody. The defendant Juraj L., on the other hand, has been released from the indictment. This verdict is not valid and KS Bratislava has not yet set the date for a public session to handle the appeals.

It may therefore happen that the case is referred to the court of first instance and that it must probably be decided by another judge such as Dutko.

Before the judge, Dutko retired at the end of 2016, chaired by Ján Jamrich, a long-time judge. His departure was also complicated by the rapid closure of a number of cases or known causes.

For example, it can not be expected that the long-running double murder case in Moste, Bratislava, which took place in 2004, will be officially ended. In the case, Jamrich was the legal judge.

They did not make the deadline

In the absence of OS BA I, no time limit was set, as the criminal case in question was loaned to the Constitutional Court of the RS for the purpose of filing a constitutional complaint.

According to TASR information from judicial sources, two voters filed a constitutional complaint, namely a sentence of life imprisonment legally condemned by the famous journalist Zemplínsky Bos Branislav Adamčo and his co-accused, Jozef B.

The new judge is BA OS I judge Roland Kemeny. The Senate, led by Jamrich, interviewed dozens of witnesses at the hearing and had to listen to others.

We do not know yet if we will have to check again. This would complicate the quick resolution of the trial case and it would take years. However, even after a possible verdict of OS BA I, it is certain that one of the parties (the prosecutor, the four accused, the TASR note) is appealing the judgment. The case would then be handled by the Bratislava call center.
