KOŠICE. Tomáš Senaj of the Press and Information Division of the Office of the Constitutional Court informed the Constitutional Court of the Slovak Republic in the first half of 2018 of the violation of the fundamental right to legal and judicial protection and the right to a fair trial.
Out of a total of 40 findings, the violation of rights to legal and other protection and fair trial concerned 23 civil cases, five administrative cases, four enforcement cases, three commercial law cases, two cases of criminal, two family cases
The misconduct of the Supreme Court
The Constitutional Court in the first half of 2018 declared a violation of the law in relation to the decision-making activity of the general courts [19659002] The most serious violation was pronounced by the Central Committee in 16 conclusions concerning the Supreme Court of the Slovak Republic, the six foundations concerned the Košice Regional Court and three trials in the District Court of Bratislava I and the Regional Court of Nitra The Constitutional Court may same time refer the case to another procedure, where the person who rendered the decision is bound in this procedure or procedure by the legal opinion of the Constitutional Court
