The first judgment in this case was handed to the Court in June 2012 when, in addition to Trajkov, he was also accused of Milan Pavlovič, Ivan Skalický and Ronald Mišech of a particularly serious crime of murder committed by an organized group. Three of them imposed jail sentences of 25 years and Skalický for life because he had already been convicted of murder. All appealed, but the Supreme Court did not allow them. Trajkov filed an extraordinary appeal, but the Supreme Court of the Slovak Republic did not allow him to rule. It has partly gone to the Constitutional Court of the Slovak Republic, which has annulled the original sentence, and the STS Trial Senate in Banská Bystrica has also had to do so.
According to the Constitutional Court, the issues were to be dealt with in a restored procedure around the "secret witness number two" mentioned in the file. Trajkov at the hearing claimed that the "confidential number two" was a fake product of the prosecutor's office and asked for the recording of his testimony. However, the prosecutor stated that the value of "secret witness number two" was zero, so he gave up his testimony. In this context, in the absence of the media and the public, the Senate also heard from two police officers, who had been deprived of their secret. On the basis of their testimony, the defense suggested to hear other witnesses, but the STS Senate did not agree.
In his final speech, the Prosecutor stated that nothing was moving and that the entire investigation was in accordance with the law. The applicant asked to be found guilty in June 2012 and to impose the same sentence. Trajkov said that he was innocent and described the process as constructive and illegal. His lawyer was convinced that Trajkov had nothing in common with his case and his guilt had not been proven.
The businessman Jozef Mišenka was murdered on July 20, 2010 in the morning. The attackers of the next car at the Mercedes fired about 30 wounds per machine gun. The prosecutor described it as a typical execution of the mafia. According to the court, it was proved that the murder was ordered by the defendant contractor Milan Pavlovič of Topoľčian to Ivan Skalický and Róbert Trajkov for the undiscovered sum. The killing also involved Ronald Mišech in providing a firearm. Macedonia Goran was shot dead by the court, but this state of the Balkans did not go prosecute abroad despite the efforts of the Slovak justice system.
Ronald Mišech also condemned drug-related crime because his marijuana plant and a large number of plants and dried cannabis were found at his home. This drug-related offense is related to the prosecution of Ivan Skalický for the crime of torture and false oath. He tentatively told him to protect Ronald's accomplice.
Another Senate of the specialized criminal court of Banská Bystrica, on October 29, examined proposals to resume the prosecution of Ivan Skalický and Ronald Mišech, convicted of the murder of entrepreneur Jozef Mishenko. He heard the two convicts, their attorney and the prosecutor, who asked that these convicts be refused. The Senate adjourned the decision indefinitely, the evidence now being processed by the competent prosecutor of the Special Prosecutor's Office.
