Former Maricopa County Sheriff Joe Arpaio lost his candidacy to the Supreme Court on Monday, challenging a lower court's appointment of a special prosecutor for his criminal case.
Arpaio has earned a national reputation because of the harshness of his conditions in Arizona jails that he has run for a quarter of a century before losing his bid for re-election in 2016.
Arpaio was found guilty of contempt of court in 2017 for failing to follow the order of a judge to stop traffic patrols that targeted illegal immigrants. President Trump then pardoned the former Sheriff of Maricopa County.
Arpaio, 86, is now trying to overturn his conviction. The case of the Supreme Court was the request of Arpaio asking the judges to annul an order of the 9th Circuit Appeals Court replacing the Ministry of Justice by a special prosecutor responsible for criminal prosecution and of the call. Frank Sheriff's lawyers claimed that the lower court's appointment was unconstitutional and stated that the 9th Circuit "does not have the power to replace the Department of Justice as US Attorney in a case." criminal ". The court decided to appoint a prosecutor because Justice Department lawyers disapproved of an order of a federal district judge refusing to overturn Arpaio's conviction.
In criticizing the appointment of a special prosecutor in the Arpaio case by the 9th Circuit, his lawyers argued that the lower court's decision "actually sent the signal that if prosecutors acted in the service of justice and acknowledged an error of the court, they would be replaced ".
The special prosecutor, Arpaio's lawyers, told the Supreme Court, "will be inherently biased in favor of defending court orders – because he knows that if he does not, he will also be replaced".
Solicitor General Noel Francisco has asked the Supreme Court not to cancel Mr. Caldwell's appointment.
