Tesla fails with urgent request for reimbursement of the electric premium

Hundreds of German Tesla customers have to pay 2,000 euros of environmental bonus. The electric car manufacturer has failed in its attempt to protect car buyers. The Frankfurt Administrative Court rejected the company's urgent request, declaring it inadmissible.

The Tesla S model was temporarily removed from the list of eligible models from November 30, 2017 to March 5, 2018. The reason was that the appropriate basic version in the trade was not available in the context of the final net price maximum of 60,000 euros.

Anyone who had purchased a Tesla S before March 6, 2018 and who had received the state's purchase premium for it had to reimburse it. The Federal Office of Economy and Export Control (Bafa) had announced in mid-July that it was about 800 cases. Another 250 claims from Tesla customers were rejected on the facts.

Tesla felt disadvantaged and went to court. This decided that checking whether the model was an eligible electric car did not affect the manufacturer's rights. Tesla could continue to sell the model. Any damage to the image resulting from the deletion is not an enforceable right.

According to the Chamber – where appropriate, the complaints could only concern the car buyer concerned, beneficiary of the state subsidy. You can appeal the decision of the Frankfurt Administrative Court to the Hesse Administrative Court in Kassel.

After new reports and promises from the American manufacturer, the Tesla S is now on the list of eligible electric vehicles. The electric award is requested since early July 2016 at Bafa. 4000 euros for a pure electric car with battery, 3000 euros for a hybrid car. Half of the premiums are funded by the federal government and the respective manufacturer.
