Taylor Swift Countersues Evermore Theme Park

Evermore, a fantasy-themed “immersive experience theme park” in Pleasant Grove, Utah, recently sued Taylor Swift for trademark infringement on her new album of the same name and related merchandise. Representatives for Swift called the claims “frivolous” and “baseless.” And now Law360 is reporting that Swift is trespassing on Evermore – for playing his music without a license.

The lawsuit filed by TAS Rights Management LLC, the company that manages the rights to the music of Swift and other brands, alleges that Evermore actors regularly performed “Love Story”, “You Belong With Me” and “Bad Blood ”for a large audience at the park – and that“ these illegal musical performances are being marketed as a central attraction of Evermore Park. ”

The TAS Rights Management lawsuit adds that Evermore ignored numerous attempts by BMI, the performing rights organization, to license the songs from the park. Swift alleges willful and vicarious copyright infringement and seeks unspecified damages, court costs, and attorney’s fees in addition to an injunction preventing the park from performing his songs.
