LOS ANGELES (AP) – Tesla President Elon Musk will have to defend himself for being laughed at by a British pedophile diver during a verbal battle that took place there. last summer after the rescue under water of young footballers imprisoned in a cave of Thailand.

A Federal Court judge in Los Angeles has set a date for the October 22 trial in a court on Friday that rejected Musk's attempt to overturn a defamation suit filed by British diver Vernon Unsworth.

Musk called Unsworth "pedo" in a July 15 issue on this Twitter account after Unsworth, in an interview with CNN, rejected Musk's attempts to help rescue football players as " cascade of public relations ". Unsworth also mocked the submarine that Musk had built for a rescue mission, pushing him to take on this Twitter account, which then counted 22.5 million followers.

Musk claimed that his insult was protected from prosecution, but the judge in charge of the case did not agree.

Unsworth claims more than $ 75,000 in damages to Musk, a multimillionaire. The prosecution is also seeking a court order barring Musk from making other derogatory comments.

This is the second time in less than a year that Musk's comments on Twitter are attacking him with legal headaches.

Last year, Musk and Tesla reached a $ 40 million settlement that allegedly misled investors with a tweet stating that it had secured funding for the takeover of the electric car maker. He then had to go to court earlier this year to defend himself against claims that he had breached an agreement with the Securities and Exchange Commission over his tweet.
