In May 2019, Tesla was facing negative publicity after one of its Model S vehicles burned down in Hong Kong. Tesla issued a statement at the time, saying:

“As a precaution, we are revising the charging and thermal management parameters of Model S and Model X vehicles via an over-the-air software update that will begin rolling out today, to further protect the battery and improve battery longevity. . “

A Model S owner who had carefully monitored his battery performance over time, David Rasmussen, complained in court in August 2019 after this software update.

In October 2019, Tesla and the owners attempted to reach a settlement agreement and lawyers stayed the litigation. Tesla rolled out another software update in March 2020 to restore the batteries of impacted owners to their maximum voltage over time while they were driving their Tesla.

Documents filed with the court this week indicate that 1,552 of the affected Tesla Model S sedans have already had their batteries fully restored, and 57 have received full battery replacements. Other Tesla owners who have experienced battery limitation should see their Model S’s maximum voltage restored as they continue to drive the cars.

As part of the proposed settlement, Tesla is also expected to “maintain diagnostic software for vehicles under warranty to notify owners and renters of vehicles that Tesla believes may require battery maintenance or repair for certain issues. battery ”.

The owners of the group include US residents who owned or leased a Tesla Model S facing battery limitations due to Tesla’s live update in May 2019. A hearing to finalize the proposed settlement is scheduled for December 9. 2021.

Tesla owners were represented by Lieff Cabraser Heimann & Bernstein, as well as YK Law of Ed Chen. Legal fees are approximately 25% of the settlement funds. They proposed that the Angeion group serve as a settlement administrator.
