Texas Governor Files Court Challenge to End Dallas County Mask Mandate

Texas Governor Greg Abbott and State Attorney General Ken Paxton on Wednesday filed a motion to stay a judge’s order requiring face masks in Dallas County schools and businesses. The order was signed despite Abbott previously barring government entities and officials from implementing hide texas warrants.

Dallas County Judge Clay Jenkins on Wednesday signed an order requiring public schools, daycares and businesses in Dallas County to develop health and safety plans that include, at a minimum, mask requirements facial for employees and visitors, reports CBS Dallas-Fort Worth. Jenkins cited the increase in COVID-19 cases and hospitalizations as the rationale behind the mask’s mandate.

Earlier this week, Jenkins sued Abbott over the executive order banning mask warrants. District Judge Tonya Parker issued a temporary injunction on Tuesday evening staying the order, reports CBS DFW.

On Wednesday, Abbott and Paxton filed a petition claiming Jenkins’ order violates the previous ban on mask warrants.

“Any school district, public university or local official who decides to challenge GA-38 – which prohibits government entities from requiring masks – will be brought to justice,” Abbott noted Wednesday. “The way forward is based on personal responsibility – not government mandates.”

A hearing on the interim injunction against the ban on mask warrants is scheduled for August 24.

Texas has recently seen an increase in COVID-19 cases and hospitalizations. According to the state health department, Texas averages about 14,000 new cases per week and about 60 deaths per week, nearly triple the number of deaths per week compared to a month ago.
