Texas will be allowed to temporarily resume its near-total abortion ban, a federal appeals court ruled Friday night – just days after the controversial law was suspended by a judge.
The 5th U.S. Court of Appeals granted Texas’ request to overturn Wednesday’s order by U.S. District Judge Robert Pitman while the case is being considered.
Many clinics in Lone Star State had rushed to reopen and serve patients in the wake of Pitman’s order – in anticipation of the appeals court ruling on Friday.
Pitman, a person appointed by President Barack Obama, wrote in his 113-page ruling that Republicans in Texas had “put in place an unprecedented and transparent legislative regime” to deny patients the right to abortion, cemented in the landmark 1973 Supreme Court decision Roe v. Wade.
It came in response to a lawsuit by the Biden administration challenging the state’s “heartbeat law”, which was signed by Gov. Greg Abbott in May and came into effect last month.
The New Orleans appeals court ordered the Justice Department to respond by Tuesday.
Known as Senate Bill 8, or SB8, the legislation prohibits abortion after detection of cardiac activity, approximately six weeks, and leaves the application to private citizens, using civil suits instead. of criminal proceedings. It authorizes the payment of $ 10,000 or more to anyone who successfully accuses a person in court of having performed or assisted an abortion.
Before the law came into force on September 1, there were about two dozen abortion clinics operating in the state.
The United States Supreme Court effectively allowed the law to remain in place after failing to grant an emergency appeal from abortion providers who sought to block the legislation.
