A panel of three judges of the US Circuit Court of Appeal ruled unanimously that attorneys general were not entitled to initiate the proceedings.

Judge Paul Niemeyer wrote in the notice: "The interest shown by the District and Maryland to enforce the emoluments provisions is so muted and abstract that their pursuit of this case easily raises the question of whether this action against the president constitutes an appropriate remedy to the courts, were created to resolve real cases and controversies between the parties ".

The President had filed motions to dismiss the case on the grounds that the District and Maryland did not have locus standi and had argued that he had not received any damages. emoluments within the meaning of the Constitution.

The three judges of the committee were appointed by the Republican Presidents.

This is not the only challenge of emoluments against President Trump. Another federal court is still considering a lawsuit brought by Democratic members of Congress.
