In a Wednesday vote of 52 to 45, the Senate confirmed President Trump's candidacy for the Ninth Circuit Court of Appeals.
The confirmation of California lawyer Kenneth Lee, marked the first time that neither one nor the other of the state Senators had returned a blue sheet, a Senate tradition that the senator from the state of origin gave his opinion on the proposed candidate, said The Hill.

Senator Dianne Feinstein and Senator Kamala Harris, both California Democrats, sent a blue paper on Lee's appointment to the San Francisco court. Lee, 43, was born in South Korea and was a special advisor to the Senate Judiciary Committee.

In a Twitter message, Feinstein cited Lee's writings on race and civil rights as reasons for his opposition. The leader of the Senate minority, Chuck Schumer, D-N.Y., Acknowledged that Lee had "shocking" positions on race and women's reproductive rights.
Senator Tom Cotton, R-Ark., Called Lee "a man of high character" and a brilliant lawyer. Both attended law school together.
"Lee's track record shows that he is far from the court system," Feinstein said, according to the Washington Times.
Lee wrote in 1994 that the incidence of AIDS among homosexuals was higher because they were more promiscular than heterosexuals. "Nine out of 10 people with AIDS are homosexuals or drug addicts," he wrote. He stated that he was "embarrassed" by this position during his confirmation hearing and that he had reached maturity since then, according to The Hill.
In another article, he wondered why a woman would continue to work for a man who had assaulted her "just to be able to keep a part-time job". At his confirmation hearing, he stated at the time of writing that he did not understand the dynamics of the workplace, according to Hill.
