Donald J. Trump for President, the Republican National Committee and the New Jersey Republican State Committee have filed a lawsuit asking the court to overturn Democratic Gov. Phil Murphy’s executive order instituting the new rules that seek to give voters the option to avoid voting in person during the coronavirus pandemic.

Trump himself has repeatedly said that expanding postal voting options will lead to fraud. In reality, there is no widespread voter fraud in U.S. elections, and non-partisan experts say neither party automatically benefits when states expand access to postal voting.

The lawsuit alleges that the executive order usurps the power of the legislature to decide when and how elections are held. He also alleges that “the system will violate the right to vote of eligible citizens” and that “fraudulent and invalid votes will dilute the votes of honest citizens and deprive them of their right to vote in violation of the Fourteenth Amendment.”

Due to the pandemic, postal voting is becoming an increasingly popular option, as many voters may prefer not to queue at polling stations. New Jersey will be the ninth state, along with Washington, DC, to mail all registered voters’ ballots for the November election.

Murphy told CNN on Friday that New Jersey was expanding the voting model used in the primary.

“We sent ballots to people who were registered in either party. We sent nominations to those who were not. And we also provided the ability to vote in person. “at least 50% in each county and at least one place in each municipality. It was a success. Not perfect, but very largely a success,” he said.

Murphy also said the state has learned some lessons since elementary school and that it “will have more of a secure drop-box presence, ensure there is physical voting capability, and as far as mail-in ballots, the good news is in a general election. The Trump campaign has also filed a lawsuit against the state of Nevada, which has a similar plan to send postal ballots to all active voters in November.
