The appointment requires the confirmation of the Senate. Vitiello, a law enforcement officer for more than 30 years, particularly with the Border Patrol, had cleared a committee and was being examined by a second. He will remain deputy director of the agency.
ICE has been at the center of much of the political controversy surrounding the enforcement of laws related to the application of immigration. Some Democrats, including a number of hopes for 2020, have called for the removal or complete restructuring of the agency.
The administration in turn rallied to ICE's defense, saying it plays a central role in protecting Americans from drugs and migrant criminals.
The confusion surrounding Vitiello's candidacy comes as the administration struggles to cope with the influx of migrants crossing the border. US officials said last week that the United States was on track to capture more than 100,000 border workers in March, a 12-year high.
The administration has repeatedly called the crisis situation and in February the president declared a national emergency situation at the border.
