Trump loses Pennsylvania election case appeal

A federal appeals court on Friday rejected an attempt by President Donald Trump’s re-election campaign to keep alive its efforts to overturn the Pennsylvania presidential election result.

A three-judge panel of the United States Court of Appeals for the Third Circuit wrote in a scathing opinion that the “Trump campaign’s claims are baseless.”

The appeals court ruling upheld a federal judge’s ruling a week earlier, which dismissed the Trump campaign’s demand to prevent Keystone State from certifying that President-elect Joe Biden had won his election.

The notice marks the latest legal defeat for Trump, who refused to concede the election to Biden and falsely claims he won the race. On Wednesday, Trump said categorically: “We must reverse the election.”

Trump’s personal attorney, Rudy Giuliani, had argued on behalf of the Trump campaign in the case before U.S. District Court Judge Matthew Brann in Williamsport, Pa. Giuliani led the charge of the Trump campaign before the court of public opinion, spreading unproven allegations of widespread electoral fraud that he said rocked the election outcome.

But the appeals court noted in its 21-page opinion that by appearing before Brann in court, Giuliani said the campaign is “not arguing fraud” in the case.

“Declaring an election unfair doesn’t make it that way,” the opinion read. “Charges require specific allegations and then evidence. We don’t have either here.”
