Monday was the first time Ginsburg, the eldest of the nine judges of the court, missed oral arguments because of his health problems, including two previous cancer diagnoses. Ginsburg also fractured three ribs during a fall in November, which led doctors to discover nodules on his lung.

If Ginsburg, one of the four liberal members of the court, was unable to continue serving, Trump could replace her with a conservative, further moving the court to the right. Trump has added two judges to the court since assuming the presidency in January 2017.
