President Petro Poroshenko presented to the Verkhovna Rada Bill No. 0206 on the termination of the Treaty of Friendship, Cooperation and Partnership between Ukraine and the Russian Federation. And in September, Kiev approved a decision not to extend the operation of this agreement and sent a note to Moscow. Thus, Ukraine quickly informed the Russian Foreign Ministry that the agreement would not be extended.
Since the treaty was ratified by the Verkhovna Rada, it is precisely she who must put an end to her operations. It is necessary to conduct the whole process of non-extension of the treaty in accordance with all the rules. Then, if Ukraine had a "contractual" power in the sense that Russia understood it, and that it suddenly wishes to reinstate the treaty, the Constitutional Court has no reason for it. 39; admit.
What are the consequences? Will the contract fail? As one day said my senior sergeant in the army: "You are not joking with a reasonable man". We have in the neighborhood an absolutely uncivilized country in which there is a dictatorship. The dictator decides what to do: if he wants to make war, he throws tanks and planes at the Ukrainian border; or if he wanted him to attack Ukrainian ships in neutral waters, he does it. Our enemy proceeds from his own point of view, and no legal or legal point here has any significance.
What will be the consequences of the failure of the treaty? As one day said my senior sergeant in the army: "You do not joke with intelligence"
Putin is not a civilized man. It's like talking about the rules of international law with Adolf Hitler. He tried to talk about it in 1938, but the price was very high. The same thing is happening now with Putin.
So, no one will now say what the consequences will be. I think that the actual consequences will not only be the abolition of the treaty itself, but more of the fact that Putin is simply nervous, the fact that Ukraine is emerging more and more from its influence. It is extremely annoying to give Tomos to the Ukrainian church. I hope this procedure will be completed in December. A massive transition from the Orthodox parishes of the deputy to the UOC will be possible. This can only be caused by Putin's mental depression. A similar reaction can be the vote in VR on the amendment of the Constitution concerning our aspirations in the EU and NATO. Or maybe an undesirable outcome of the presidential election. That is, the aggression can cause anything.
The legal consequences always arise, if the transaction is unlawfully broken – such as is not written in the agreement itself. However, since we have fully complied with the procedures, there will be no negative legal consequences for us. We have arrived at the moment when the treaty of friendship can be officially terminated. That's what happens.
For Ukraine, after the termination of the Treaty of friendship with the Russian Federation, there will be no change.
For example, a provision that was bad for us would disappear. Russia should also run it, but did not run it. Ukraine needs to consult Russia before becoming a member of international associations or to seek partners and sign agreements with them. Moscow could not veto it, but we had to consult it. In other words, if we wanted to join some sort of association that Russia considered prejudicial to itself or dangerous – the EU or NATO – it could have insisted that we do not do it. Because in the treaty about friendship, it is written that we are not allowed to join unions that could harm the other party. And Russia accordingly – too. Russia, when it created the Customs Union, did not consult us for any reason. But it was asked of us vis-à-vis NATO and the EU.
Ukraine will not make any changes after the end of the Treaty of Friendship with the Russian Federation
However, this norm will no longer be applied.
In addition, in The Treaty of Friendship with Russia was positive for the standard that both countries grant citizens of the second party the same rights as their own citizens. This should mean that Ukrainian citizens in Russia can be employed without additional permits, with the same rights as Russians. But Russia did not do it on the first day of the contract. Russia has always introduced separate rules, permits and registrations for Ukrainian workers. This is to say that the only beneficial standard for Ukrainians did not apply a single day. So, here we do not lose too much.
And all the rest is in the intergovernmental agreements that continue to work.
The termination of a framework agreement (and the Treaty on Friendship is a Framework Agreement) does not result in the termination of the actions of those agreements that have been approved its basis. There is an agreement on borders, in which our borders are clearly delimited, according to which the Donbass is a territory of Ukraine and Crimea is an unconditional territory of Ukraine. The only is the border in the sea of Azov. As a result, this agreement remains valid and will not cease to exist after the Treaty of Friendship. Any other agreement also ceases to exist until we leave it in the same way as those arising from these agreements or from international law.
Therefore, those who claim that Ukraine, having left the treaty of friendship with the Russian Federation, there is no agreement to assert that Russia recognizes our territorial integrity
Therefore, those who claim that Ukraine, having left the Treaty of friendship with the Russian Federation, are not truthful, there is no agreement allowing to affirm that Russia recognizes our territorial integrity. Because there are other agreements and they are kept.
Will Russia be able to use one way or another to achieve its goals in the absence of a friendship treaty? Russia will be able to justify its actions in the eyes of its citizens. And for the international community, where the rules of international law apply, it will not matter. Separate statements – if the Ukraine liquid this treaty, Russia has no obligation as to its territorial integrity with respect to us – it's a complete lie, because there is another agreement that clearly defines borders.
