Kelsey Berreth's fiancée on Monday heard Colorado attorneys formally accuse her of five crimes related to the disappearance and alleged murder of the mother of her one-year-old child.

Patrick Frazee, 32, was informed at a hearing. He was charged with first degree murder, first degree murder and three counts of soliciting first degree murder, FOX31 Denver reported.

The crime murder charge accused Frazee of killing the 29- year old flight instructor during a robbery.

Berreth was last seen at a grocery party in a supermarket. That day, Frazee announced that he and Berreth had exchanged custody of their 1-year-old daughter, Kaylee. Police said they thought Berreth had been killed after the exchange of custody data at his home.

Three days after his disappearance, his cell phone rang 600 km into Idaho and his boss received a message from his phone telling him that she was taking off that week. Her mother reported her disappearance on December 2nd.

Berreth's body was not found, nor did the police or prosecutors say how she was killed or why. They did not discuss the evidence they had to indict Frazee.

"All the facts in this case are under seal, so I can not tell you about any potential motives," said Teller County Attorney Dan May.

He is the only one arrested in this case.

May told reporters that prosecutors had not yet decided to apply the death penalty.

Berreth's parents were given Kaylee custody during a hearing last week. Kaylee lived with Frazee after Berreth's disappearance.
