WASHINGTON – The United States Supreme Court ruled on Monday not to fight over whether President Donald Trump's appointment of Matthew Whitaker as the acting Attorney General was illegal by dismissing a petition against him. 39, case in a pending firearms case. Trump named William Barr, Attorney General of former President George HW. Bush, to succeed Sessions as Attorney General. Some of the same lawyers are involved in a similar effort to challenge Whitaker's appointment before a federal judge in Maryland.
Maryland Attorney General Brian Frosh has asked a federal judge to ban Whitaker from appearing in court.
Maryland also argued that Trump had violated the "nomination clause" of the Constitution because the Attorney General is a "senior officer" who must be appointed by the President. and confirmed by the Senate.
An American Democratic senator took a similar action.
The Department of Justice defended the legality of Whitaker's appointment, claiming that Trump was entitled to entrust him with this post under a 1998 law entitled Federal Act on Job Vacancy Reform, even though He was not a senior official confirmed by the Senate.
Congressional Democrats had expressed concern that Whitaker could undermine Special Advisor Robert Mueller's investigation into a possible conspiracy between President Trump of 2016 and his President. election campaign and Moscow.
