The Administrative Court of Appeal of Kiev partially satisfied the appeal filed by the National Bank of Ukraine and left without examination the declaration of the former shareholders of PJSC "JSCB Capital" on the recognition of illegality and the abolition of the regulator's decisions on withdrawal from the market. According to the report, the shareholders of Capital Bank, Promgaz Ukrainy LLC (15% of the shares) and Ruslan E. Shcherban (34%) in August 2017 filed a lawsuit against the NBU Deposit Guarantee Fund. Individuals with a request for recognition of illegality and the abolition of decisions on the withdrawal of this bank from the market.

Kyiv District Administrative Court on March 15, 2018, Prosgaz Ukrainy LLC trial and Shcherbanya Ruslan Evgenevich partially satisfied. In particular, it declared illegal and abolished the decisions of the BNU Administrative Council concerning the classification of the bank "Capital" as a category of insolvency and its liquidation.

Disagreeing with the decision of the court of first instance, the National Bank of Ukraine lodged an appeal in April 2018.

the court of appeal quashed the decision of the court of first instance , and the prosecution Promgaz Ukrainy and Ruslan E. Shcherban left without consideration.

Recall that JSCB "Capital Bank" was awarded to the National Bank of Ukraine insolvent categories on July 20, 2015 and October 29, 2015, a decision was made to liquidate this bank.
