Sims sues Trump "in his official capacity as president" and seeks an injunction against the confidentiality agreements he was given by Trump when he was working at the White House.
CNN asked the White House to comment on the lawsuit.
Sims' book, "Team of Vipers: My 500 Extraordinary Days at the White House," published in January, is his honestly chaotic white house story.
The prosecution is asking a court to rule that" Trump "can not enforce, directly or through non-US government cuts, any confidentiality agreement seeking to unconstitutionally violate its First Amendment rights."
"The purpose of this action is to permanently prevent the defendants from silencing Mr. Sims with respect to any information he may have learned during his tenure as a federal employee, as well as any right or privilege possible legal protection, "reads the document.
In the lawsuit, Zaid claims that the US government "seeks to impute Mr. Sims' civil liability by applying applicable NOA to information that Mr. Sims has learned only while serving in the federal government".
