SALT LAKE CITY – Republican Republican Mia Love filed a lawsuit on Wednesday to stop counting votes in the race in Utah where she closely follows her Democratic challenger.
Love's campaign stated in a lawsuit that the Salt Lake County Clerk was not allowing election observers to challenge the findings during the process of verifying postal ballots. Voting is done primarily by mail in Utah.
Campaign observers saw instances of approval of a ballot when the signature did not seem to match the one on the record, he said.
The advocate of the love campaign, Robert Harrington, said in a statement that he "accuses no one", but that he has already seen some cases that call for a closer look.
No hearing was immediately fixed in the case.
County Clerk Sherrie Swenson, a Democrat, did not immediately return the messages requesting comment. His office was expected to publish additional results on Wednesday afternoon.
Love's challenger, Ben McAdams, is leading Love by less than a percentage point as the vote count continues in the race that remains too close to be followed more than a week after the polling day. McAdams is the mayor of Salt Lake County, where most of the district's voters live.
His campaign did not immediately comment on the lawsuit.
The Utah law makes it possible to challenge the eligibility of an elector, but it is unclear how this applies to the recently adopted postal vote by most state counties. . Utah's Chief Electoral Officer, Justin Lee, declined to comment.
This is not the first Republican lawsuit against Swenson's office during this election cycle. A few days before the vote, two GOP candidates accused him of failing to send thousands of ballots to voters on time, but the case was dismissed after a hearing.
A similar lawsuit was filed Tuesday in New Mexico by a Republican who lost her bid for a seat at the American House. Yvette Herrell has asked a county judge to seize the mail ballots so that his campaign can inspect them after the County Advisory Council has certified that Democrat Xochitl Torres Small has won.
