COCOA, Florida – Five Florida teens will not be prosecuted after they filmed and mocked a handicapped man as he drowned and did not help. Attorneys told Florida Today that teens could not be prosecuted because there is no state law that requires a spectator to help or get help for someone who is in danger.
The teenagers saw Jamel Dunn, 31, struggling in a pond last July, but instead of helping him, they filmed him and then put him on the line.
In the one minute video, teens hear Laugh and scream at Dunn, telling him that he is going to drown and that they are not going to help him. They call it "silly".
The state prosecutor, Phil Archer, said Friday in a statement that the teenagers were "ruthless" but that under the law they could not be prosecuted.
Police said last year that Dunn entered the pond alone. They were not sure if he was suicidal, but said that he had recently had a fight with his fiancee. Dunn's body was only found five days after the incident, reported CBS Orlando affiliate, WKMG-TV.
