Wanda Barzee, the woman found guilty of her role in the abduction of Elizabeth Smart, will be released on September 19 from a Utah prison.
Barzee, 72, will be released because the parole board did not give credit for the time spent in a federal prison, the Utah Pardons and Parole Commission said Tuesday.
This is a surprise reversal by the board, which deprived Barzee of an early exit in July. At the time, the parole board refused to include his eight years in federal prisons as time spent on state charges.
"After further review and advice from a legal counsel, the board must count the time spent in federal custody on Ms. Barzee's state sentence," said Greg Johnson of the Fox Commission.
Smart, now 30, did not have an immediate comment.
Barzee had confessed to helping her husband Brian Mitchell kidnap Smart in his bedroom in Salt Lake City in June 2002. The couple held captive Smart, then 14, for nine months.
The couple was arrested in 2003 and Barzee pleaded guilty in federal court in November 2009. Three months later, she pleaded guilty to attempted kidnapping in July 2003, about a month after Barzee and Mitchell. caught Smart.
In May 2010, Barzee was sentenced to one to 15 years in the state of Utah for aggravated kidnapping.
Barzee returned to Utah in 2016 after serving his federal sentence in Texas and began serving his Utah prison sentence.
In June, the parole board calculated that his sentence would continue until January 2024, but this did not take into account the time spent in federal prison.
Mitchell is serving two life sentences in a federal prison for kidnapping and sexual assault.
