A federal appeals court ruled on Tuesday that protesters attacked at a 2016 Trump campaign rally could not sue on the grounds that Donald Trump had incited violence with inflammatory rhetoric.
The issue was a rally on March 1, 2016 in Louisville, Kentucky. Take them out of here, "Trump said of protesters at the event. "Get them out," he said a few minutes later, then added, "Do not hurt them. You see, if I say "go ahead", I have problems with the press.
Video clips of the rally show protesters pushed and pushed by members of the public.
The US-based Sixth Court of Appeals, based in Cincinnati, said that Trump's words had not prompted a riot, as protesters claimed in their lawsuit.
The court also ruled that Trump's words enjoyed protection based on the first amendment "because he did not advocate an imminent action of anarchy."
The protestors' lawyers argued that Mr. Trump's remarks should be evaluated in the context of other pre-meeting statements in which the presidential candidate seemed to tolerate the mistreatment of the protesters.
Mr. Trump's lawyers responded that he had not requested the use of force and that he had the right to exclude intruders from his campaign.
Tuesday's decision overturned a court ruling that refused to dismiss the complaints against the president.
