The New York Attorney General's office is urging a state court not to drop its case against President Trump's charitable foundation, saying the foundation has repeatedly violated federal and state laws.
Attorney General Barbara Underwood said that the Donald J. Trump Foundation "was a shell corporation that functioned as a checkbook from which the business entity known as the" Trump Organization "was making payments."
Underwood continued the foundation in June, claiming that she had repeatedly solicited money from donors and that she had then used it for campaign purposes, in violation of the federal electoral law. The money has also been used to benefit Trump's commercial interests, by settling lawsuits against it, for example, said Underwood.
Underwood also stated that Trump's three oldest children – Donald Trump Jr., Ivanka Trump and Eric Trump – had not exercised any real control over the activities of the foundation, although they were nominal members of the council. administration.
In August, the foundation asked the New York State Supreme Court to dismiss the case, saying it had not broken any laws.
The foundation said the trial was politically motivated and that Underwood's predecessor Eric Schneiderman, who had opened the investigation, had promised to "lead the resistance" against Trump. Schneiderman resigned in May as a result of allegations of physical abuse against women.
Underwood said Thursday in the filing of his case that the foundation had misrepresented the claims against him and urged the court to allow the case to continue.
Underwood asks the court to dissolve the foundation and claims $ 2.8 million plus additional penalties.
