For nearly two weeks, the lawyers for the seven defendants – three clinics, three doctors and the midwife who practiced the procedure – argued that their clients played only a minimal role in the incident. They accused an erroneous chain of communication that led doctors and clinic owners to believe that the infant had only a small cut after the procedure, not a life-changing injury.

The midwife and one of the doctors were found responsible for the injuries sustained by DJ, but the jury had to decide how much money the family was to receive for this medical error, depending on the contribution of each of the seven accused to the situation.

The jurors used a questionnaire to answer yes or no to specific questions about the respect of professional standards by each of the defendants in the way they handled the error. These responses determined the total amount awarded and the amount each defendant would have to pay.

Today, the jurors had to return to the deliberation room because they felt that Dr. Ann Siguion would have to pay 10% of the settlement, even though she was initially not responsible. His lawyers argued that it would be illegal to charge for it.

The jury returned a second time, finding Dr. Siguion responsible. Now, each accused is responsible for covering a percentage of the $ 31 million – the midwife paying 50%, a doctor 30% and the other two 10% each.

Since the failed circumcision, DJ has undergone multiple surgeries but unfortunately is permanently injured. The family lawyer said that DJ would probably need more surgeries and other medical treatments in the future.

There was an inconsistency in the form of the verdict in the division section, because the jury awarded Anne Sigouin 10% of the verdict, although it was clear before that she was not responsible for the injuries sustained. by the plaintiff. With respect to the objections of all the defendants, the court created an additional verdict form for the jury to complete the one relating to Anne Sigouin and then asked the jury to return to the jury room and deliberate again on Anne's responsibility. The jury did and then completely changed her determination of responsibility regarding Anne Sigouin, concluding that she was responsible. The jury awarded another 10% of the total verdict to Anne Sigouin. The defense verdict for my other client, Life Cycle Pediatrics, LLC, has not been disrupted and this company has been completely exonerated. We respectfully believe that the Court's decision to allow the jury to reconsider Anne Sigouin's liability was a mistake, depriving her of the defense verdict she had originally received. Accordingly, we intend to appeal this decision with other decisions made by the Court in this litigation..
