CNN has contacted the US Attorney's Office in Massachusetts for more information. It is not known whether Vazquez was assigned to legal representation.
Vazquez was one of seven crew members on Sunday aboard Captain Billy Haver, a fishing vessel located about 55 miles off Massachusetts, according to an affidavit filed by a US Coast Guard Special Agent. .
According to the affidavit, a member of the crew said he heard shouts coming from the deck of the boat and ran to investigate. He was hit on the back of the head three times and fell. According to the affidavit, the crew member stated that he was looking up to see Vazquez with a knife in one hand and a hammer in another. Another crew member was lying on the deck with blood coming out of his mouth, said the crew member.
Vazquez would then have hit a third member of the crew with a hammer before getting on the mast of the ship to escape from other crew members who attempted to capture him, according to the office of the US Attorney.
A German cruise ship, the Mein Schiff 6, responded to a distress call from the captain of the fishing vessel.
Two of the injured crew members were taken aboard the liner. One of them was declared dead on the scene, according to the affidavit.
WBZ reported that the fishing vessel was based in Virginia.
Previous arrest
The court documents indicate that Vazquez was in the United States illegally.
In March, Vazquez was arrested in Newport News, Virginia on charges of forcible abduction, intimidation or deception, according to the affidavit. He was released on bail. On April 2, he was placed in immigration proceedings, but released on April 23 from US immigration and customs custody, the affidavit said.
If he is found guilty, Vazquez risks up to life imprisonment for murder charge and up to 20 years in prison for attempted murder. Lelling's office said Vazquez would be subject to an eviction proceeding after serving any sentence imposed.
