A Uber driver sues Jameis Winston about a sexual assault

Tampa Bay Buccaneers quarterback Jameis Winston is currently finishing a three-game suspension imposed by the NFL for attacking an Uber pilot. The league's investigation during the off-season concluded that Winston had "violated the policy of personal conduct by touching the driver in an inappropriate and sexual way without his consent". Winston denied the allegations, but apologized to the driver in July she "and called the situation" a learning experience ".

On Tuesday, Winston was sued by the driver – identified only as "Kate P." – for sexual assault. She asked for "exemplary or punitive damages". The lawsuit, filed in federal Arizona court, tells a story similar to that reported by Buzzfeed in November 2017.

Early in the morning of March 13, 2016, according to the lawsuit, Kate accepted an application from Uber of a "Jameis W" to drive from a club in Scottsdale to a hotel in Phoenix. As Kate stopped, the suit indicates that one of the men with whom Winston was with said, "She is hot. You should sit on the front seat, Jameis. Winston did just that, and Kate left with him as the only passenger. According to the lawsuit, Winston did not seem to be particularly drunk, but he seemed angry and hungry:

Immediately after leaving the International Club car park, the Defendant Winston became belligerent with male pedestrians who were close to the same obscenities and racial epithets at the window. It did not appear that Mr. Winston knew that these people and the plaintiff were worried that a fight was going to break out and that his vehicle could be damaged. The grievor lifted the windows of the vehicle, which temporarily interrupted the hostility for the vehicle to move away.

After driving another block, the accused Winston demanded, "I want a burrito". The complainant asked him where he wanted her to pick him up and he replied, "I do not care, I just want a burrito.

Kate led a passage through, and while her lawsuit says, Winston assaulted her sexually:

While waiting for the food to arrive and without any warning, the accused Winston leaned toward the plaintiff and placed his fingers between his legs and pressed them firmly against his vagina over his yoga pants.

Concerned by the hostility of the accused Winston, the plaintiff was very anxious to react in such a way as to again incite the accused Winston. The plaintiff looked at the defendant then came back to his hand and asked, "What's up with that?" The defendant Winston then withdrew his hand.

The lawsuit says Kate did not talk to Winston for the rest of the trip and they arrived at the hotel without anything happening. Kate then texted her boyfriend saying, among other things, "I've just been molested by Tampa Bay Buc QB". Initially, not wanting to attract negative attention, she finally decided to present her story as a result of #MeToo.

Kate's attorney, John Clune, is the same attorney who represented Erica Kinsman in his own lawsuit for sexual assault against Winston. Monday.
