Black man defends against racist attack, unintentionally kills assailant, does not go to jail

In Portland, Oregon, Timothy Warren, a 41-year-old FedEx driver, did not know he could kill a man in an argument about dangerous driving. When he stopped his truck to face Joseph Magnuson, who had shouted that Warren was driving his delivery truck too fast, he began to launch insults and racist slurs.

Magnuson, whose insults were implacable even after Warren's explanation, was out of his car, just like Warren. According to Warren, Magnuson, 55, plays first. Warren stepped back, striking the enemy 's left eye with a single shot.

Magnuson will collapse, losing consciousness briefly. He died later in the night.

What happens next will shock you: Prosecutors have decided not to accuse Warren, a black man, of crime.

Magnuson's death was precipitated by "an extremely bad health," according to a medical examiner. Deputy Attorney General Adam Gibbs also concluded that the punch itself was less than fatal.

"They report," writes Gibbs, "that Mr. Magnuson then" very aggressively "started yelling at Mr. Warren for him to slow down." Mr. Warren stopped his truck while Mr. Magnuson continued to reprimand him. Witnesses agree that Mr. Magnuson described Warren as "a fucking Negro" in combination with other aggressive and abusive expressions "over and over again."

Three witnesses who saw the fight said that Magnuson threw a drink before tipping.

Warren has not yet been contacted for a comment. Honestly, Good for him. Unfortunately, there is no guarantee that he would have benefited from witnesses, an impartial attorney or today's Thanksgiving dinner elsewhere.
