The NCAA announced on Friday that BYU basketball would be subject to several penalties after determining that an anonymous student-athlete, considered guardian Nick Emery, was receiving a litany of inappropriate benefits from the boosters.
Among the sanctions imposed by BYU are the results of the vacations in which Emery participated, ie 47 wins between the 2015-16 season and the 2016-17 season.
University basketball programs receiving penalties because of these shenanigans are a tale as old as the NCAA, but this one has a distinct flavor of Provo. The reason why: Emery would have received some of BYU's most imaginable gifts.
The inappropriate benefits that Nick Emery would have received
Between the release of the NCAA and a Salt Lake Tribune report last year, here are some of the gifts that Emery would have received:
- Free golf outings
- Free meals in a country club
- Use of a Volkswagen Jetta
- Tickets for U2 concerts in Los Angeles and Toronto, which have also been opened by The Lumineers
- A trip to the magical world of Harry Potter
In total, the NCAA determined that Emery had received more than $ 12,000 in gifts.
Many of these gifts would have been provided by Brandon Tyndall, a travel company executive and member of BYU's Cougar Club. Emery posted photos of himself with Tyndall on many trips to Snapchat and Instagram.
Who is Nick Emery?
So far, Emery's main claim was the moment he was kicked out of a first-year match against rival Utah for hitting an opposing player in the face. Utah's dramatic reaction to the punch was to try to stop future matches against BYU, but the Utes finally pulled back.
Emery himself was sanctioned by a suspension of the next BYU match, a victory against the Weber State which is also the only victory that BYU will not have to leave from his two seasons with Emery.

In the field, Emery was a key contributor to BYU. According to Rivals, as a four-star playmaker in the 2013 class, Emery joined the team in 2015 after a two-year Mormon mission. He contributed 14.7 points, 3.3 rebounds and 2.5 assists per game in his first and second year seasons.
Emery was dismissed when the NCAA began investigating him and Tyndall before his first year in 2017. He then withdrew from the university, citing difficulties related to his divorce, but was reinstated for the 2018-1919 season while he was suspended for nine games.
BYU's response to NCAA sanctions
BYU strongly condemned the NCAA decision in a statement released Friday and announced its intention to appeal.
The complete declaration:
"We are disappointed with the decision announced today by the NCAA Committee on Offenses (IOC). The CI review is the result of a self-declaration by BYU to the NCAA. From the beginning, BYU considered the potential infractions as a serious matter and cooperated in all ways with the revision of the NCAA. There was no institutional knowledge or involvement in the offenses. In fact, the NCAA found that Coach Rose promotes an atmosphere of compliance and monitors the program.
"The lapse penalty of the record is extremely severe and unprecedented given the details of the case. For more than two decades, the NCAA did not force an institution to cancel its matches in similar cases where the CDI found that there was no institutional knowledge or involvement in the violation, whether it was coaches or other staff of the university. In fact, this sanction includes the most severe penalty for a registration vacation ever taken in the history of NCAA Division I for offenses involving no knowledge or institutional involvement. In addition, in the most similar cases, appropriate sanctions were imposed, but no victory was canceled. BYU believes that the termination penalty is unfair and inconsistent with the NCAA precedents. The university plans to appeal the decision.
