ASHEVILLE, N.C. (AP) – The largest outbreak of chickenpox in North Carolina since the introduction of the vaccine in 1995 has resulted in a court challenge.
Asheville Citizen-Times reports that two of the 104 students at the quarantined Asheville Waldorf School challenged the November 1 order, claiming that it violated their civil liberties.
The three-week quarantine applied to unvaccinated children and offered their parents a choice: vaccinate the children, prove that they were immune to the virus or move them away from others. According to Jennifer Mullendore, Medical Director of Buncombe County Health and Social Services, it is unusual for the majority of parents in Asheville Waldorf to choose quarantine.
Last Thursday, a judge canceled part of the order, saying the county had the power to prevent children from going to school but could not prevent them from leaving home . The quarantine order expired on Tuesday.
